State agency employees are entitled to a paid day off from work on a national, state, and skeleton crew holiday that the State observes as outlined in Texas Government Code, Chapter 662 .

Dates and descriptions of Texas state holidays are defined within Texas Government Code, Section 662.003. In accordance with Section 662.003(b), June 19 (Emancipation Day) is listed as a state holiday and not a national (federal) holiday and therefore requires a skeleton crew.

The State Auditor’s Office provides the holiday schedules to assist state agencies and has no interpretation authority over state holidays or state agency closures. In accordance with Texas Government Code, Section 662.012, the Office of the Comptroller of Public Accounts (Comptroller’s Office) establishes procedures and rules to administer holidays. Questions regarding holidays should be addressed to the Comptroller’s Office.

A state agency must have enough state employees on duty during a state holiday to conduct the public business of the agency, except on state holidays that fall on a weekend, the Friday after Thanksgiving Day, December 24, and December 26 (Texas Government Code, Section 662.004).

An employee who actually works on a national holiday or a state holiday, if the holiday does not fall on a weekend, will be allowed compensatory time off during the 12-month period following the date of the holiday worked (Texas Government Code, Section 662.007).

Holiday schedules for the biennium are posted after the close of each legislative session.
